Terms of Service

These Terms of Service (“Terms”) govern the use of Cyclips (“the Service”, “we”), a managed service that turns video recordings into short clips using artificial intelligence, operated by Facundo Jose Escobar Cello as a sole proprietor based in Italy. By creating an account or using the Service, you accept these Terms in full.

Description of the service

Cyclips is an AI-assisted video editing tool. The user uploads video content they own (for example, the recording of their own live stream or broadcast), or provides the link where they published it so the Service can bring it in, and the system analyzes that content to automatically identify and generate short clips, with a suggested title, description and tags, ready to publish on social media.

Cyclips does not generate synthetic content, and does not create artificial images, voices or videos — it only analyzes and trims existing video content that the user uploads to the platform.

Responsibility for content

2.1. Each time the user uploads a file or provides a link for the Service to bring in a video, the user represents and warrants that:

  • They hold the copyright to the content, or have the express authorization, license or permission of its owner to obtain it, process it with the Service and distribute the resulting clips.
  • When they provide a link, the video published at that link is theirs or belongs to someone who authorized them to obtain and process it, and they are entitled to have the Service bring it in from that platform.
  • Their use of the processed content (including publishing it on social media) does not infringe copyright, trademarks, image rights, the terms of the platforms where they publish it, or any other third-party right.

2.2. Cyclips acts exclusively as a technical processing tool. When the user provides a link, Cyclips obtains that video on the user's behalf and at their direction, as a tool at their service: it does not choose the content, does not publish it or make it available to third parties, and the video and clips are only accessible from the user's account. The original video brought in by link is not offered for download. Cyclips does not verify ownership of the content or the truthfulness of the user's statements, and has no obligation to do so. Legal responsibility for the content uploaded or brought in by link, processed and distributed through the Service rests exclusively with the user.

2.3. It is expressly forbidden to use Cyclips to obtain, process, generate clips from, or distribute content over which the user does not hold the corresponding rights, including but not limited to broadcasts, streams, videos or recordings belonging to third parties without their authorization, whether uploaded as a file or provided by link.

2.4. Before bringing in a video by link, the user must accept these Terms and the Privacy Policy by checking the corresponding box. Cyclips records that acceptance and the representation in section 2.1 with the date and time, the link provided, the video's public details, and the IP address and browser used. The user agrees that this electronic record serves as evidence of their acceptance and representation, with the same value as a signature.

2.5. The user shall hold Cyclips, its owner and its providers harmless from any claim, lawsuit, damage, fine, cost or expense (including reasonable attorneys' fees) arising from the content they upload or bring in by link, from any false or inaccurate statement, or from a breach of these Terms, and shall cooperate with Cyclips in its defense.

Copyright claims

If a third party believes that content processed through Cyclips infringes their copyright, they can notify us by writing to visorapp.online@gmail.com. Upon a valid notice, Cyclips may delete the content in question and the clips made from it, without prior notice, and suspend or close the account of the user involved, particularly in case of repeated claims. Cyclips may provide the record described in section 2.4 to the competent authorities or in legal proceedings related to the claim.

User accounts

The user is responsible for keeping their access credentials confidential and for all activity that occurs in their account. Cyclips reserves the right to suspend or cancel accounts that breach these Terms.

Plans, payments and billing

Current prices, plans and billing conditions are detailed on the Service's pricing page. Payments are processed by an external payment provider (Merchant of Record) acting as the authorized reseller of Cyclips before card networks and payment methods.

Service availability

Cyclips is provided “as is”. While we work to keep the Service available and running correctly, we do not guarantee uninterrupted availability and we are not responsible for outages beyond our reasonable control.

Limitation of liability

To the maximum extent permitted by applicable law, Cyclips shall not be liable for indirect, incidental or consequential damages arising from the use of the Service, nor for third-party claims arising from content uploaded or brought in by link by the user, including claims by the platforms where that content is published.

To the maximum extent permitted by applicable law, Cyclips's total liability to the user for any cause related to the Service is limited to the amount the user paid Cyclips in the twelve months before the event giving rise to it.

Nothing in these Terms excludes or limits liability that applicable law does not allow to be excluded or limited, such as liability for willful misconduct or gross negligence, nor the rights the law grants the user as a consumer.

Changes to these Terms

We may update these Terms at any time. Significant changes will be notified through the Service or by email. Continued use of the Service after an update implies acceptance of the new Terms.
